2024 ALBURY WODONGA BUSINESS AWARDS (AWBA) TERMS & CONDITIONS OF ENTRY

To enter the Awards in 2024, you will need to agree to the Awards Entry Terms and Conditions, so please take the time to familiarise yourself with these before commencing the entry process.

Albury Business Connect’s Privacy Statement will also apply to your entry and involvement in the Awards.

As part of your involvement in the Awards, we will collect personal information relating to you and your business, including any materials and responses you provide that are used in the Awards judging process. This includes you in your personal capacity, in your capacity as a representative of the business entering the Awards as well as the business being entered into the Awards.

We may also share any information we collect with related entities, business partners, and/or other third-party service providers engaged to help AWBA with the Awards, and may continue to do so, after the Awards have concluded. We will never sell your information to any third party, nor will any information be provided to overseas entities or persons.

By participating in the Awards, you consent to those who have access to your personal information using it to administer the Awards, send you promotional materials, and invite you to participate in initiatives (e.g. surveys) to improve both our products and services as well as those of partners and service providers that we have engaged to help AWBA administer and improve the Awards.

General Eligibility

To enter one of the outstanding business categories in the Awards, a business must:

  1. Entries are free for all eligible businesses located within .
  2. Have a registered Australian Business Number (ABN) and be registered for at least 12 months.
  3. Be registered in Albury Local Government Area (LGA), Wodonga Local Government Area (LGA), Indigo Shire and any business in NSW within a 70km radius of the Albury GPO. Business must be able to demonstrate that a significant proportion of your trading activity (ie revenue and profits) is derived here.
  4. Must be a sole trader, partnership, franchisee, incorporated Pty Ltd, or incorporated association. If the entrant is a not-for-profit, it must hold an ABN.
  5. Not be a franchisor; an ASX listed company; club; co-operative; government department, agency, statutory body (educational institutions are excepted), instrumentality of government, including government owned corporations and companies; division of another business, or more than 50% owned by another business.
  6. Be more than 60% Australian owned with the owners and founders making the key management decisions.
  7. Be trading solvent and not subject to any litigation, insolvency or bankruptcy proceedings that may potentially adversely impact the reputation of the business, and by association, the Awards. If the entrant goes into administration, voluntary receivership, liquidation or bankruptcy at any time after submitting an entry, the entrant is required to withdraw their entry.
  8. Not have filed for bankruptcy in the previous 5 years or been subject to court proceedings in the previous 12 months. This also applies to any business owner’s and founder’s personal capacity.
  9. Not have been purchased or subject to sale or acquisition, or about to go through the process of being sold during the Awards window 15 April to 23 August 2024.
  10. Not be an employee of the Naming Rights Sponsor.
  11. Not be involved in judging the category they are entering. This also applies to any of their employees.
  12. Not be a supplier of commercial products and services that relate only to a single sponsor, category or judge.
  13. If they are a Category Sponsor, not enter the award category they are sponsoring. This also applies to any of their employees. Sponsors can enter an award they are not sponsoring.
  14. Must be willing to participate fully and ensure owners, founders and/or authorised representatives are available to attend Awards events and associated activities where required.
  15. Only NSW registered businesses are eligible to categories that align with the Business NSW Awards program.

To enter one of the individual outstanding business leader categories and Hall of Fame category in the Awards, an individual must:

  1. Be over 18 years of age from the date you register your entry.
  2. Be employed or active in a leadership capacity in a local business in the Albury Wodonga and surrounding area during the Awards window 15 April to 23 August 2024.
  3. Not have filed for bankruptcy in the previous 5 years or been subject to court proceedings in the previous 12 months from the date when you register your entry. This also applies to any business that you have owned or been employed by, and especially any businesses you are relying on to demonstrate your leadership credentials.
  4. Not own or be employed by a business trading insolvent and/or subject to any litigation, insolvency or bankruptcy proceedings that may potentially adversely impact the reputation of the business or you as a leader/ Hall of Fame inductee, and by association, the Awards.
  5. Not be involved in Judging, sponsoring or providing products and services to any single category for the Awards.
  6. Must be willing to participate fully and attend the Awards events and associated activities where required.

Entry Process

To enter the Awards, all entrants must:

  1. Create an account in our online awards platform.
  2. Read and accept the Awards Entry Terms and Conditions, acknowledging you have read our Privacy Statement, and declare that the information to be provided in your entry submission will be true and correct to the best of your knowledge.
  3. Complete all requirements for the awards entered and submit the entry online.
  4. Complete and submit all entry requirements between 9.00am 15 April 2024 and 11:59pm AEST 31 May 2024.
  5. Submit a separate entry for each Award you wish to enter.
  6. Only submit one entry per Award.
  7. Not request that your entry be moved into another Award after entries have closed.
  8. Not assume that a single entry into the Awards will either result in a position as a finalist or result in a winning entry.

Disqualification

Any breach of these terms and conditions, including bringing the Awards program into disrepute may result in the disqualification of your entry(s).

Judging Process

  1. Finalists for each Award will be selected by a panel of judges based on the information provided in the entry submission.
  2. Finalists for each Award may be required to complete an interview with the judging panel in-person or at their business premise as part of the process to determine a winner. Interviews will be held in July 2024.
  3. Finalists for each Award must be willing to provide further information, including financial information, to support the judging process if requested. This will be kept strictly confidential and will not be shared or used outside the judging process.
  4. The judging panel may, in its sole discretion, request further information from entrants at any time as part of the judging process.
  5. Judging of entries will be in accordance with the responses to the criteria on the entry form and interviews (where required) with the judging panel. The winner of each Award will be chosen on merit.
  6. The judging panel will consist of a panel of business representatives selected by the Awards Steering Committee based on abilities and expertise relevant to that Award. Each Award may be judged by a different composition of the judging panel. The Chief Judge will have oversight of the judging panel and judging process and will have the final say in its ultimate discretion on all decisions.
  7. The decision of the judging panel’s decision is final, and no further discussion or correspondence will be entered into.
  8. By entering the Awards, entrants acknowledge that under no circumstance will judges and the Albury Wodonga Business Awards be held responsible for any comment, viewpoint or expression, whether expressed or implied, concerning the standard or quality of entries, and agree not to bring a claim against any judge, the Albury Wodonga Business Awards, Albury Business Connect, Business Wodonga, or any sponsors in relation to feedback on entries.
  9. To the extent permitted by the law, the Albury Wodonga Business Awards, Albury Business Connect and Business Wodonga will not be liable for any loss or damage or personal injury suffered or sustained in connection with the Awards. The applicant will indemnify Albury Wodonga Business Awards, Albury Business Connect and Business Wodonga, and its officers, employees or agents against any loss or liability from any claim or action that arises as a result of a breach of these terms by entrants, or by entrant’s use of the materials or information supplied by entrants under these Entry Terms and Conditions.

Finalist and Winner Notification

  1. Finalists for each Award will be publicly announced at the Finalists Night on Wednesday, 3 July 2024 and notified thereafter.
  2. One winner will be selected for each Award and announced at the Gala Awards ceremony to be held on 23 August 2024. Winners will be publicly announced.

Marketing and Promotion

  1. By entering the Awards, entrants authorise the logo, business identity, details about your business or personal identity to be used in any materials which promotes the Awards or your products or services.
  2. By entering the Awards, entrants allow Albury Wodonga Business Awards to provide any comments about the Awards and to take photos or video footage of the applicant’s business and representative(s) and use any of the material collected as part of the applicant’s entry (excluding any financial information). If we use the materials, you grant AWBA a royalty free, perpetual and irrevocable license to use these materials to promote the Awards.
  3. Albury Wodonga Business Awards reserves the right to use and publish photographs and digital video recordings taken at both the Sponsor and Finalist event and the Gala Awards ceremony for the purposes of advertising and promotion. Entrants who do not wish to comply with this must notify Albury Wodonga Business Awards prior to these events.

Intellectual Property

  1. All the intellectual property rights related to the Awards, including the information and data we collect, belong to AWBA, and you will still own any intellectual property rights you owned before you entered the Awards. You also agreed to assign all intellectual property rights related to all materials that arise, and/or are created in the present and future, in relation to your participation in the Awards
  2. The applicant irrevocably and unconditionally grants an irrevocable license and thereby consents to all acts being done by Albury Business Awards that may otherwise be construed as a breach their moral rights in any material created by them and provided to Albury Business Awards during the Awards and at any time thereafter for a period of 12 months.

Force Majeure

  1. If for any reason (including any cause beyond the control of the Albury Wodonga Business Awards) the Awards are not capable of running as planned, or where running the Awards would corrupt or affect the administration, security, fairness, integrity or proper conduct of the Awards, the Albury Wodonga Business Awards reserves the right, in its sole discretion, to take any action that may be available, and to cancel, terminate, modify or suspend the Awards.
  2. The Albury Wodonga Business Awards reserves the right in its sole discretion to disqualify entries from any individual who tampers with, or benefits from tampering with, the entry process which as a result corrupts or affects the administration, security, fairness, integrity or proper conduct of the Awards.
  3. In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders its determination, the Albury Wodonga Business Awards may in its absolute discretion cancel the Awards and recommence it from the start on the same terms and conditions.

Failure to comply with the AWBA entry terms and conditions, or any act that brings the awards into disrepute grants AWBA the right to disqualify you or declare your entry ineligible.
